General Terms:

Do not swing your katana carelessly.

Treat all swords with regard and respect as you would a loaded gun. Katanas have caused loss of limb and life even in the hands of trained expert during public demonstrations. Anytime your sword leaves the scabbard, make sure everyone around you is well out of reach of you and your weapon. Inspect your katana each time you handle your sword. The katana is a heavy weapon that can slip out of your grip easily. Precaution should be taken to make sure there are no one in the way of your swing as well as your trajectory if the sword should slip or fail.

Swords are not toys!

Improper use and handling of a live katana may result in serious injuries or death to yourself or bystanders. Please keep any knives or blades out of reach or children and never handle a katana in a dangerous or threatening manner.

Use only with Proper Training on Suitable targets!

These swords are meant to be used ONLY in a proper martial arts dojo (school) under the supervision of a qualified instructor as a training aid. Proper martial arts dojo refers to schools such as kendo or iaido dojos recognized by the AUSKF (All American Kendo and Iaido Federation). These swords are made and tested ONLY for use in Kata (form practice) and Tameshigiri (cutting practice) in a dojo setting. The only material it should cut would be wet, rolled tatami omote (tatami covering) or goza and straw mats and nothing else... EVER.

These swords are NOT designed for nor are they intended for any: blade to blade contacts, cutting of live vegetation, animal tissue, items containing metal, wood, concrete, water filled containers, or any loose fabric ropes and lines, or cutting of any substance where you may not encounter unexpected foreign objects. Any use of the sword in such manner or on such targets will void any and all warranty.

We will NOT sell any swords to minors or to regions where live sword sale is prohibited by law. Please check the regional regulations of your country or area before placing any orders with us. It is your responsibility to make sure that purchase, shipping, and possession of such a weapon is legal.

Any of our weapons purchased through online auction sites or outside of our store and authorized dealers will be considered a second hand sale. All warranty through us will be null and void (warranty will be via the actual seller).

A katana sword is a live weapon that is only intended for display or use by martial arts professionals with proper training and under supervision of a qualified instructor. Do not use the swords under any circumstances unless you are ranked by a internationally recognized federation as capable of handling a live blade and under the supervision of a ranked instructor.

Our katanas are designed for use only within a dojo setting in mind, and on goza only as is it the only and official target type to be used in official training, rank testing, and competitions.

Prior to using ANY katana, a thorough and detailed inspection is required by a trained swordsmith professional to verify metal/parts integrity and proper assembly. Do not attempt to disassemble a sword unless it is done by a trained and qualified professional using proper tools and techniques. Improper disassembly techniques will damage components of the sword.

Unless all necessary precautions are taken as described above, never ever use a katana.

Consider all of our katanas sold for display purposes only. We will not be held responsible for any damages, injuries, or death resulting from use or misuse. Any warranty, refunds, exchanges will be immediately void upon use.

Do not strike your sword against another sword in mock battle. Katanas are never intended to be struck edge to edge. The Japanese katana is a slashing weapon and may be used for light parry using the flat corners of the blade. It is never intended to absorb a forceful strike from a rigid instrument. Doing so will easily break or damage your blade to the point where it loses integrity. Our swords have been further lightened with the "blood groove" and thus never intended to strike or absorb strikes from a rigid object.

Do not strike your sword against a hard surface or attempt to cut wood or chop trees. Doing so may damage your blade to the point where it loses integrity which may cause serious injuries or death.

Shipping Terms:

The point of sale is considered to be in San Diego, California. Shipping service provided by us is considered optional. You can arrange to pick up your items or have an agent or freight forwarder do so once items have been paid. We will also ship your items to your specified destination as a courtesy and act as an agent on your behalf using our default shipping methods. However, we are acting only as agents for coordinating with shippers of choice and will not be liable for any lost items or damages sustained in transit.

Domestic orders will be shipped via UPS or USPS at our discretion. Tracking number is not provided automatically, but may be requested if shipment does not arrive in the expected time frame. Average transit time is 7 days within the continental US, 2 weeks for orders to HI, AK, and Canada, 3 weeks for all other international shipments. Items less than 1 lb or addressed to PO Box, HI, AK will be sent via USPS and not UPS. Both USPS Priority Mail and UPS Ground Shipment may be used for items over 1 lb.

International orders will be shipped via USPS Priority by default. Tracking number is not provided automatically but may be requested if shipment does not arrive in the expected time frame. By the default shipping method, we act only as an agent on your behalf for coordinating with USPS, and you are considered the shipper of record. We will not be held liable for shipping damages, lost items, or shipment seized or returned by Customs. Re-shipment or refunds due to undeliverable packages is available only if package is returned and received. You can also choose to use any domestic freight forwarder of your choice and have your orders sent as a domestic order, or have your agent pick it up here for you. We recommend Access USA, which is familiar with shipping swords in bulk internationally.

Free shipping offer(and discounted shipping rate for international shipment) only applies to original purchase. Any re-shipment will incur actual shipping charges.

Payment Terms:

Money Order, Mastercard, Visa, or any other method accepted by PayPal (our order processing gateway) are accepted. Paypal credit card payments incurrs a 2.9%+$0.30 processing fee, which will be deducted from the total payment amount. This processing fee will not be reflected as an additional amount in the total paid by the buyer. The seller (Cheness) will pay the processing fee from total amount collected for completed orders.

Cancellations and Order Changes:

Orders not yet shipped may be cancelled for a refund without incurring shipping charges or restocking charges. Instruction for cancellation must arrive by email prior to 8:00 am PST on the day of shipping. PayPal credit card payments will automatically incur a 2.9%+$0.30 processing fee, paid to PayPal at the time of order and is not refundable. Cancellation for orders completed but not yet shipped will be eligable for a refund of the full payment amount less the non-refundable PayPal fees.

Order may be modified if not yet shipped. Instruction for change must arrive by email prior to 8:00 am PST on the day of shipping. Changes including increase in quantity or change to a higher priced item will require additional payments by either invoicing or direct PayPal or Credit Card payments. Changes including reduction of item cost or quantitiy will be refunded the difference of the original and the modified order minus the 2.9%+$0.30 PayPal processing charges paid to PayPal.

Return Policy:

We are not responsible for losses or damages sustained in transit (please see shipping terms). Any shortages or damages sustained in transit must be reported and noted at the time of receipt of merchandise and Cheness Incorporated must be notified within 72 hours of receipt of merchandise if you choose to have us file claims against the shipper on your behalf.

For any and all returns a Return Authorization number (RMA#) must first be obtained before any merchandise can be returned, otherwise returns will not be accepted. All cartons returned must have the RMA# printed on the outside of the box and be visible or the package will be refused.

No call tags or reimbursement of shipping charge will be issued for returns under any circumstances, including mis-shipments or product defect (since original shipping was provided as a courtesy free of charge or at a discounted rate).

Only new and unused merchandise will be accepted for replacement or credit within 30 days of purchase. Used and misused, or improperly cared for products will not be accepted even if defective. Use of product after receipt constitutes as acceptance of the product in their present state as received, and will render the sale as-is and final. All returns will be replaced with the identical product returned unless the item is unavailable in which case credit will be issued.

Merchandise accepted for return for reasons other than manufacturer defects or errors are subject to a 20% restocking fee. Merchandise must be returned within 30 days form date of purchase. Shipping fees and PayPal processing fees are the responsibility of the purchaser under any conditions.

If you are not satisfied with your purchase of a product, please email us for a Return Material Authorization (RMA) request within 72 hours of the receipt of the product. Used products, personalized or otherwise customized products may not be returned for refund or exchange under any circumstances. The product must be returned to the Cheness Inc. within 15 calendar days of the issuance of the RMA. All products must be packed in the original, unmarked packaging including any accessories, manuals, documentation and registration that shipped with the product. A 20% restocking fee will be applied if you cancel an order once it's shipped. Refund will be process upon the item is returned on purchase's expense.

Please note that Cheness Incorporated does not permit the return of or offer refunds for the following products:

• 1. Product returns without an authorization from Cheness Inc.
• 2. Product that is custom configured by any party either by request or personally
• 3. Product had been used for cutting or handled excessively such that components (including ito) becomes dirty or matted
• 4. Products damaged to incorrect maintanence or disassembly.
• 5. Products are not Cheness-branded
• 6. Products are not sold by Cheness Inc. directly

** NOTE: Cheness Inc. recommends that you (1) use a carrier that offers shipment tracking for all returns and (2) either insure your package for safe return to Cheness Inc. or declare the full value of the shipment so that you are completely protected if the shipment is lost or damaged in transit. If you choose not to (1) use a carrier that offers tracking and (2) insure or declare the full value of the product, you will be responsible for any loss or damage to the product during shipping.

Release, Assumption of Risk, Waiver of Liability and Indemnity Agreement:

By purchasing any item sold by Cheness Incorporated, the buyer expressly warrants that he/she is in compliance with all applicable Federal, State, and Local laws and regulations regarding the purchase, ownership, and use of the item.

It shall be the buyers responsibility to comply with all Federal, State and Local laws governing the sales of any items listed, illustrated or sold.

The buyer expressly agrees to indemnify and hold harmless Cheness Incorporated for all claims resulting directly or indirectly from the purchase, ownership, or use of the items.
